Membership Terms and Conditions

1. Principle Terms

1.1 This agreement is between you and Bayside Fitness Ltd trading as Bayside Fitness

1.2 This agreement commences once you have completed the e-signature in the signup process.

1.3 You will be entitled to all rights and privileges exercisable for the type of membership chosen, subject to the timely payment of the relevant membership fees and the successful processing of your direct debit or card instruction.

2. Membership

2.1 Persons wishing to become members of the Club shall complete the membership sign up process through the Club website. The Club reserves the right to reject any application for membership with giving any reasons for so doing. By ticking the “agree to Terms and Conditions” box during the sign-up process the member agrees to comply with these Terms and Conditions of Membership.

2.2 You will only be permitted to use the Club facilities provided your membership is current and fully paid up.

2.3 The minimum age to become a member is 16. If you are agreed between 16-18 you must provide relevant ID and approval from a parent or guardian.

3. Membership Categories

3.1 The Club may offer different categories of membership. Your choice of category on joining will determine the fees you pay and any restrictions that may apply to your use of the Club facilities and services. You may change to any other available membership category with 30 days’ notice.

4. Duration

4.1 When you join the Club, you are agreeing to remain a member for an Initial Contract Period which will depend on which membership you have chosen. Your membership will automatically continue on a rolling monthly basis following your Initial Contract Period requiring 30 days notice to terminate from your next scheduled payment date.

5. Fees

5.1 Should any membership fees not be paid within 30 days of the due date, the full membership fee for the remainder of the Contract Period will automatically become due and payable in full.

5.2 All membership and other fees are reviewed periodically. For any changes to the monthly fee we will give members at least 30 days notice.

6. Timetable and Bookings

6.1 The Club reserve the right to change the class or Personal Training timetable and/or the trainer teaching the class at its discretion.

6.2 All bookings for classes and Personal Training should be made through the Club website or app.

6.3 The cancellation period for classes or Personal Training is at least 4 hours in advance of the class or Personal Training session. Cancellations less than 4 hours in advance will be treated as the member not having attended the class/session and may result in a €4 no-show fee which will be charged to the members card on file.

7. Termination of your membership by the Club We may terminate this agreement under any of the following circumstances:

7.1 If you commit a serious or repeated breach of this agreement of the Club’s rules of membership and the breach, if capable of remedy, is not remedied with 7 days of receipt of a default notice

7.2 If any part of your membership fee remains unpaid 30 days after its due date for payment

7.3 If you engage in any illegal activity or activity which we deem to be unacceptable behaviour

8. Cancellation of your membership

8.1 You may cancel your membership by giving us 30 notice in advance of the end of the relevant contract period for your membership. The relevant contract period is the Initial Contract period or the monthly rolling contract if the Initial Contract period has passed.

8.2 You must provide the Club with notice of your request to cancel your membership. IF you do not provide us with notice, you are still obliged to pay the membership fees as you are still a member of the Club.

9. Club Rules

9.1 Club Rules will be displayed in the Club, displayed on the Club website or emailed to members as appropriate. The Club may amend the Club Rules from time to time in order to ensure the health and safety of members.

10. Restriction of Liability

10.1 The Club will not accept any liability for any loss, damage to or theft or money, valuables or other personal property of members and guests. Nor will the Club accept liability arising from acts or omissions of third parties who may provide services at the Club facilities.

11. Health and Safety 11.1 Members must read all Health and Safety notice displayed in the Club and comply with their recommendations.

11.2 The Club has a zero-tolerance policy on the use, sale or purchase of illegal drugs or non-prescription steroids on the premises and reserves the right to eject or terminate a membership for contravening this.

11.3 Members must agree to the following waiver: I hereby understand and acknowledge that the training, programs, classes, treatments and events held by the Bayside Fitness Ltd may expose me to many inherent risks, including accidents, injury, illness, or even death. I assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in.
